RE: The tariff classification of an air crib from China.

Dear Ms. Oddy:

In your letter dated August 19, 2008, you requested a tariff classification ruling.

The AirCrib 2G is an infant travel bed. It is a collapsible sleep system designed with four individual nylon chambers, four mesh panels and four corner mesh panels. The four individual nylon chambers have inflatable polyurethane insert bladders. The unit measures 40 inches long, 24 inches high and 28 inches wide. Accessories include a mattress with nylon slip cover, hand pump and stuff sack. The AirCrib is designed to be placed on the floor when in use. The applicable subheading for the AirCrib will be 9403.70.4010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other furniture and parts thereof: Furniture of plastics: Of reinforced or laminated plastics: Household.". The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
