RE: The tariff classification of bicycle racks from China.

Dear Mr. Tilton:

In your letter dated September 9, 2008, you requested a tariff classification ruling.

You have submitted descriptive literature for five bicycle racks. They are all made of welded steel construction and powder coated. Models RS6002, Two Bike Gravity Stand, RS6500, Free Standing 4 Bike Stand and RS7002, Multi-use Utility Rack are all designed to stand on the floor. Models RS4000, Single Bike Rack and RS4007C, Single Bike Rack with tire tray are designed to hang on the wall.

The applicable subheading for the RS6002, RS6500 and RS7002 will be 9403.20.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other metal furniture: Other: Counters, lockers, racks, display cases, shelves and similar fixtures”. The rate of duty will be Free.

The applicable subheading for the RS4000 and the RS4007C will be 8302.50.0000, HTSUS, which provides for “Hat racks, hat pegs, brackets and similar fixtures and parts thereof, of base metal”. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
