RE: The tariff classification of Glycacil SG Perservative

Dear Mr. McCue:

In your letter dated October 31, 2007, on behalf of Lonza Inc., you requested a tariff classification ruling.

The subject product, Glycacil SG Perservative is a preparation containing 6% of the active ingredient, iodopropynyl butylcarbamate (IPBC), in a proprietary solvent. Glycacil SG Perservative is an Environmental Protection Agency (EPA)-registered fungicide and is indicated as an intermediate preparation that will be used to manufacture other household goods.

The applicable subheading for the Glycacil SG Perservative will be 3808.92.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Insecticides, rodenticides, fungicides, herbicides, antisprouting products and plant-growth regulators, disinfectants and similar products, put up in forms or packings for retail sale or as preparations or articles (for example, sulfur-treated bands, wicks and candles, and flypapers): Fungicides: Other: Other: Other. The rate of duty will be 5% Ad Valorem.
