RE: The tariff classification of an injection cylinder unit from Austria

Dear Mr. Vroman:

In your letter dated August 15, 2005 on behalf of Engel Canada Inc. of Guelph, Ontario you requested a tariff classification ruling.

Descriptive information, pictures, bills of material, schematics, etc. have been submitted for types of injection cylinder units which are subassemblies of an injection unit for a plastic injection molding machine. It is Engel’s opinion that classification should be under HTS subheading 8477.90.8510 as other parts of injection molding machines. This product will be generally entering as a component of a complete injection molding machine however there is the potential of the injection cylinder unit being imported separately as a service part.

A memo on the injection cylinder unit ‘s functionality from Engel Canada describes the operation as follows. Melted plastic and rubber compound materials are introduced to the closed mold halves by means of an injection unit. The injection unit of an injection molding machine consists of an “injection cylinder unit”, a sub-assembly to which is fastened a “screw drive assembly” and a “plasticizing assembly”. It is supported on and guided by one or two linear bearing rails. The “injection unit” is moved into position by means of two extension bars fastened to the back of the stationary platen and to the ends of two (carriage cylinders) piston rods which comprise part of the injection cylinder unit.

The applicable subheading for the injection cylinder unit imported separately will be 8477.90.8510, Harmonized Tariff Schedule of the United States (HTS), which provides for other parts of injection molding machines. The rate of duty will be 3.1 percent.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
