RE: The tariff classification of glass cullet from China

Dear Mr. Kiley:

In your letter dated February 19, 2003, you requested a tariff classification ruling regarding glass cullet. Representative samples were submitted with your ruling request.

The submitted samples, which you identified as glass cullet, consist of broken pieces of clear glass with sharp edges in various sizes and shapes. You indicated in your letter that you will be importing glass cullet in plastic bags inside a cardboard box. Each box will be labeled with an item number indicating it is cullet. The cullet will be imported for re-sale into the United States and then re-melted and used in the production of glass.

The applicable subheading for the glass cullet will be 7001.00.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for cullet and other waste and scrap of glass…: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
