RE: The tariff classification of a garden care tool kit from China

Dear Ms. Soto:

In your letter dated June 20, 2002, you requested a tariff classification ruling, on behalf of your client, Delstar Security & Wireless, Hallandale, FL. The sample that you submitted with your request will be returned to you as requested.

You have described your sample as a 16-piece Garden Care Kit which includes the following components:

? 1 Multi-pattern spray nozzle - made of brass, metal and plastic (used to dispense water) ? 1 Roll of plant ties - made of plastic twist tie type metal wire (PVC coated) on a dispenser ? 6 piece quick connect hose kit (plastic) ? 1 Kneeler pad ? 1 Cultivator ? 1 Trowel ? 1 Hand pruner ? 1 Weeder ? 1 Grass shears ? 1 Transplanter ? 1 Plastic carrying case – manufactured of molded plastic and is specially fitted on the interior to hold various gardening tools

The item is determined to be a GRI 3 set. The essential character of the set is imparted by the six hand tools for working in the garden, classifiable in heading 8201. All of the tools have metal working edges. These hand tools include a transplanter, cultivator, trowel, hand pruner, weeder and grass shears. The applicable subheading for the 16-piece garden care kit with its fitted carry case is classifiable under subheading 8201.90.6000, HTS, which provides for handtools of the following kinds and base metal parts thereof: other handtools of a kind used in agriculture, horticulture or forestry, and parts thereof: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
