RE: The tariff classification of two glass vials from France

Dear Mr. Gumbs:

In your letter dated March 31, 2000, on behalf of your client, SGD Pharma, Inc., you requested a tariff classification ruling. Representative samples and descriptive literature were submitted with your ruling request.

The subject merchandise, which is described as “Mix-o-Vial” bottles, consists of two small clear glass bottles, SGD 21120(2 cc capacity) and SGD 20180(1 cc capacity).

You indicated in a telephone conversation that this product will be used to pack and convey a drug.

The applicable subheading for the two glass vials will be 7010.94.0500, Harmonized Tariff Schedule of the United States (HTS), which provides for carboys, bottles, flasks, jars, pots, vials, ampoules and other containers, of glass, of a kind used for the conveyance or packing of goods; other of a capacity: not exceeding 0.15 liter: serum bottles, vials and other pharmaceutical containers. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
