RE: The tariff classification of CCD cameras and parts from Japan.

Dear Mr. Housman:

In your letter dated August 23, 1999, you requested a tariff classification ruling.

The literature you submitted refers to 4 items that are described as follows: Color CCD Camera (model YH-7B570) which your literature states is specifically designed for video conferencing (live motion video and utilizes an NTSC signal). It is imported as a fully functional CCD video camera. Color CCD Camera (model YH-7B120) which you state is the same as camera model YH-7B570 except it does not have housing nor lead wires. The camera consists of a lens, a compact camera CCD head, and a single video processing board. You state that the camera can be connected to a power source and used by customers who want to use their own housing. Color CCD Camera Module (model YH-9TM1) consists of a CCD board and a lens only. The module is not capable of converting or processing the image data. Integrated Circuit with Lens (model LZOP3800) the sample submitted is a single piece, which has a lens on top of an integrated circuit that captures the light from the images and converts it to electricity. This is merely CCD raw data, analog signal. The item is not capable of converting or processing the image data.

The applicable subheading for both of the CCD cameras (models YH-7B570 and YH-7B120) will be 8525.30.9005, Harmonized Tariff Schedule of the United States (HTS), which provides for which provides for “Transmission apparatus for television: Television cameras: Other: Color.” The rate of duty will be 2.1 percent ad valorem.

The applicable subheading for both the CCD Camera Module (model YH-9TM1) and the integrated Circuit with Lens (model LZ0P3800) will be 8529.90.7800, HTS, which provides for “Parts suitable for use solely or principally with the apparatus of headings 8525 to 8528; Other parts of articles of headings 8525 and 8527, except parts of cellular telephones; Of televisions apparatus; for television cameras; Mounted lenses suitable for use in, and entered separately from, closed-circuit television cameras, with or without attached electrical or non-electrical closed-circuit television camera connectors, and with or without attached motors.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
