RE: The tariff classification of wire garland from China
Dear Ms. Kearney:
In your letter dated June 17, 1997 you requested a tariff classification ruling on behalf of your client Berwick Industries Inc.
A sample of "Holiday Classics Super Silk Ribbon Garland", was submitted with your inquiry. The garland measures 2 inches in width and 12 feet in length. It is comprised of 33 percent polyethylene and 66 percent of polyester. Note that, for tariff classification purposes the garland is not considered a textile material. Tinsel wire runs lengthwise inside the folded and sewn ribbon edges. The submitted article has a white iridescent appearance but will also be manufactured in other colors including: gold, silver and emerald. The decorative garland is affixed to a display card for retail sale. It's intended use is for decorating the home during the holidays.
According to your letter the garland will be assembled in China of U.S. supplied ribbon and tinsel wire. The foreign processing will include cutting the ribbon garland and tinsel wire to length and sewing the tinsel wire edging onto the garland with nylon thread. The garland will then be placed on the display card for export to the U.S. You state that the country of origin will appear on the same side of the card as "Berwick, PA."
The applicable subheading for the "Holiday Classics Super Silk Ribbon Garland" will be 9505.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for festive, carnival or other entertainment articles: confetti, paper spirals or streamers, party favors and noisemakers; parts and accessories thereof. The rate of duty will be free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
