RE: The tariff classification of women's garments from Hong Kong. Dear Mr. Riley: In your letter dated May 9, 1990, you requested a tariff classification ruling. Style number 24062, which you describe as a "2 piece pajama set", consists of a woman's blouse and a pair of pull-on trousers. Both components are cut and sewn from 100% polyester woven fabric. The blouse has gold-colored piping extending around the neckline and down the edge of the right-front panel, and also around the edges of the sleeves. The piping has no counterpart on the trousers and is not the same color as the fabric of the blouse and trousers. The blouse also has long sleeves, a round neckline without any collar treatment, a full frontal opening secured by five metal buttons, sideseam vents, and a straight bottom. The trousers have a fully elasticized waistband. Style number 2406, which you describe as a "sleepshirt", is a women's blouse which is cut and sewn from 100% polyester woven fabric. The blouse, which extends approximately five inches beyond the midthigh, has gold-colored piping extending around the neckline and down the edge of the right-front panel, and around the edges of the sleeves. The garment also has long sleeves, a round neckline without any collar treatment, a full frontal opening secured by six metal buttons, sideseam vents, and a straight bottom. The samples are being returned, pursuant to your request, under separate cover. The applicable subheading for the two blouses will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's blouses, shirts and shirt- blouses of man-made fibers. The rate of duty will be 28.6 percent ad valorem. The applicable subheading for the trousers will be 6204.63.3510, HTS, which provides for women's trousers and breeches of synthetic fibers. The rate of duty will be 30.4 percent ad valorem. The two blouses fall within textile category designation 641, and the trousers fall within textile category designation 648. Based upon international textile trade agreements, products of Hong Kong are subject to a visa requirement. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
