Title II of the Genetic Information Nondisclosure Act, referred to in subsec. (h)(1)(A)(iv), probably means title II of the Genetic Information Nondiscrimination Act of 2008, Pub. L. 110–233, May 21, 2008, 122 Stat. 905, which is classified to chapter 21F (§ 2000ff et seq.) of Title 42, The Public Health and Welfare.

The date of the enactment of this Act, referred to in subsec. (j), probably means the date of enactment of Pub. L. 119–60, which enacted subsec. (j) of this section and was approved Dec. 18, 2025.

Prior Provisions

A prior section 10104, Pub. L. 98–89, Aug. 26, 1983, 97 Stat. 561, related to regulations, prior to repeal by Pub. L. 101–225, § 214(a)(1).

Amendments

2025—Subsec. (a)(1). Pub. L. 119–60, § 7315(1), substituted “sexual harassment or sexual assault in violation of employer policy or law or harassment” for “harassment, sexual harassment, or sexual assault in violation of employer policy or law”.

Subsecs. (h) to (j). Pub. L. 119–60, § 7315(2), added subsecs. (h) to (j).

2022—Pub. L. 117–263 added subsecs. (a) to (g) and struck out former subsecs. (a) and (b) which read as follows:

“(a) A master or other individual in charge of a documented vessel shall report to the Secretary a complaint of a sexual offense prohibited under chapter 109A of title 18, United States Code.

“(b) A master or other individual in charge of a documented vessel who knowingly fails to report in compliance with this section is liable to the United States Government for a civil penalty of not more than $5,000.”
